Use policy
This Use Policy (the “Policy“) sets out what you may and may not do with CyberYozh Data. It is binding on everyone who uses our tools, proxy network or managed services, and it reflects the standards we actually follow in practice, not statements written only for this page. This Policy forms part of, and is subject to, our Terms of Service; where the two conflict, the Terms of Service and applicable law prevail.
1. Scope and Definitions
1.1 This Policy is issued by WebGears Services d.o.o., registration number 22038745, registered under Serbian law with a legal address at Jurija Gagarina 231/329, Novi Beograd, Beograd, Serbia (the “Company,” “we,” “us”), which operates the CyberYozh Data platform.
1.2 The “Services” include our open-source, self-hostable web scraper (the “Scraper,” based on the yozh-scraper engine), the “Yozh Crawler” (which walks a site from a start URL, streams discovered pages and fetches each one through the Scraper over HTTP), our ethically-sourced Proxy Network, and any managed scraping we provide. “You” or the “Client” means any person or organisation using the Services. A “Target Site” is any website or resource you access using the Services.
1.3 This Policy applies whether you run the open-source tools on your own infrastructure or use our hosted Proxy Network and managed services. When you self-host, you remain fully responsible for your targets, configuration and outputs, and this Policy continues to bind any traffic you route through our Proxy Network or managed service.
2. General Principle
2.1 You may use the Services only for lawful and legitimate purposes. You are solely responsible for your use case, your configuration, the targets you choose, and for determining that your collection and use of data is lawful in every jurisdiction that applies to you.
2.2 Ethical data collection is built into how we run the platform. Open-source code is only the starting point; how data is collected and how proxies are sourced matters just as much, and we expect the same standard from you.
3. Permitted Uses
3.1 The Services are designed for responsible data collection. Subject to this Policy and applicable law, you may use them to:
- collect data that is publicly available and not restricted by law, contract or access controls;
- monitor prices, markets, travel fares, availability and other public signals;
- track SEO, SERP results and search visibility;
- carry out brand protection and intellectual-property enforcement;
- conduct academic, journalistic or non-commercial research;
- perform ad verification and compliance checks; and
- test, monitor and quality-assure your own websites, applications and other properties.
4. Prohibited Uses
4.1 You must not use the Services to access data that is behind a login, paywall, authentication or other access control, unless you have a clear right or permission to do so.
4.2 You must not circumvent authentication, paywalls, access controls, security systems or anti-bot measures without authorisation.
4.3 You must not use the Services to carry out or support any of the following:
- denial-of-service or distributed denial-of-service (DDoS) attacks, or any activity that places an undue burden on a Target Site;
- distributing malware, introducing malicious code, or exploiting vulnerabilities;
- phishing, fraud, impersonation, spoofing, account takeover or credential stuffing;
- spam or unsolicited mass messaging;
- ad fraud, click fraud or generating invalid traffic;
- fake engagement, fake reviews, and vote, rating or ranking manipulation;
- manipulating search rankings through fake clicks or artificial signals;
- ticket-buying, scalping or other bots that unfairly acquire limited inventory; and
- producing or spreading disinformation, scams or deliberately misleading content.
4.4 You must not resell, sub-license or redistribute the Proxy Network, Scraper output or other Service features without our prior written consent.
4.5 Copyright and other intellectual-property complaints are handled under our DMCA Policy, which provides the notice-and-takedown intake path for such matters.
5. Personal Data and Privacy
5.1 You may collect or process personal data only where you have a valid lawful basis and only in a manner consistent with applicable law, including the GDPR and the CCPA where relevant, and as described in our Privacy Policy.
5.2 You must never use the Services to harvest personal data for unlawful purposes such as surveillance, doxxing, discrimination or harassment. You must exercise particular caution with sensitive-category data and data relating to children.
6. Target-Site Stability and Rate Limits
6.1 You must respect the stability of every Target Site. Because the Yozh Crawler walks a site from a start URL and fetches many discovered pages, you must set sensible concurrency and crawl-delay, throttle your requests, and honour published rate limits and robots.txt directives.
6.2 You must not degrade, disrupt or overload a Target Site or its infrastructure. If a site signals that it does not wish to be crawled, you are responsible for handling that appropriately.
7. Restricted Targets and Vetting
7.1 Certain categories of Target Site are restricted or prohibited. These are listed in our separate Restricted Targets Policy, which forms part of this Policy; please review it before you begin collecting.
7.2 We may verify your identity and intended use case, and may ask you for further information. We may refuse, restrict, suspend or terminate access to any use case we consider illegal, unethical, high-risk or non-compliant, particularly for higher-risk products such as residential proxies.
7.3 We operate a transparent Proxy Network. Participants join our network knowingly and with informed consent, and we source proxy capacity ethically rather than through hidden or deceptive means.
8. Monitoring and Enforcement
8.1 We may monitor for, and investigate, suspected abuse, including through automated abuse-detection systems.
8.2 Where we detect a violation, or a risk of harm to third parties, we may warn, throttle, block, suspend or terminate your access, in some cases without prior notice, at our sole discretion and without liability for doing so. You may forfeit access and any related fees as set out in our Payment and Refund policy.
8.3 We take firm action against illegal use and may cooperate with, and provide assistance to, law enforcement and other competent authorities.
8.4 Our failure to enforce any provision of this Policy is not a waiver of it. We may update this Policy from time to time, with the changes taking effect on their stated effective date.
9. Reporting Abuse
9.1 Fast abuse response is one of the standards we hold ourselves to. If you believe the Services are being misused, contact us at abuse@cyberyozh.com. We aim to acknowledge reports within one business day and to investigate promptly.
