Introduction
Welcome to CyberYozh Data.
These Terms of Service (“Terms”) govern your access to and use of data.cyberyozh.com, including our websites, documentation, APIs, open-source software, GitHub repositories, Model Context Protocol (MCP) integrations, developer tools, and any related services (collectively, the “Services”).
By accessing or using the Services, you agree to be legally bound by these Terms. If you do not agree with these Terms, you must discontinue use of the Services.
These Terms form a legally binding agreement between you and WebGears Services d.o.o. (“CyberYozh,” “we,” “our,” or “us”).
Please read these Terms carefully together with our Privacy Policy, Cookie Policy, and any additional policies or guidelines that may apply to specific Services.
Definitions
For the purposes of these Terms:
CyberYozh Data refers to the developer platform available at data.cyberyozh.com, including its websites, documentation, APIs, software, GitHub repositories, MCP integrations, and related services.
Services means all products, software, APIs, documentation, developer tools, downloadable resources, websites, support channels, and other functionality provided through CyberYozh Data.
Software means any software published, distributed, or maintained through CyberYozh Data, including but not limited to Yozh Scraper, Yozh Crawler, SDKs, examples, scripts, command-line tools, and related components.
User, you, or your refers to any individual or legal entity accessing or using the Services.
Content means documentation, text, code samples, APIs, tutorials, guides, images, software releases, configuration examples, changelogs, and other materials available through CyberYozh Data.
Third-party services means external services, platforms, APIs, AI providers, hosting providers, payment providers, or software maintained by organizations other than WebGears Services d.o.o.
Acceptance of these Terms
By accessing, browsing, downloading, installing, cloning, contributing to, or otherwise using CyberYozh Data, you confirm that:
- You have read and understood these Terms.
- You agree to comply with these Terms and all applicable laws and regulations.
- You have the legal capacity and authority to enter into this agreement.
- If you are using the Services on behalf of a company or other legal entity, you represent that you have the authority to bind that organization to these Terms.
If you do not agree with any part of these Terms, you must not access or use the Services.
Additional policies, license agreements, or service-specific terms may apply to certain features or Services. In the event of a conflict, those service-specific terms will govern only the relevant Service.
Eligibility
CyberYozh Data is intended for developers, researchers, businesses, educational institutions, and other professional users.
By using the Services, you represent and warrant that:
- You are at least 18 years of age or the age of legal majority in your jurisdiction.
- Your use of the Services complies with all applicable laws and regulations.
- You will not use the Services in any jurisdiction where their use is prohibited by applicable law.
- You are not subject to sanctions, export restrictions, or other legal prohibitions that would prevent you from using the Services.
If you use CyberYozh Data on behalf of an organization, you represent that you are authorized to act on behalf of that organization.
About CyberYozh Data
CyberYozh Data is an open-source developer platform designed for web scraping, website crawling, AI-powered automation, and structured data collection.
The Services may include, but are not limited to:
- Yozh Scraper
- Yozh Crawler
- Public APIs
- Model Context Protocol (MCP) integrations
- Developer documentation
- GitHub repositories
- Technical tutorials and examples
- Open-source software releases
- Community resources
- Support services
- Additional developer tools made available through the platform
CyberYozh Data is intended to help developers build, automate, and integrate lawful data collection workflows using publicly accessible information.
Certain Services may be provided free of charge, while others may require registration, authentication, API credentials, or payment where applicable.
We may add, modify, suspend, replace, or discontinue any part of the Services at any time to improve functionality, maintain security, comply with legal requirements, or support the continued development of the platform.
Unless otherwise expressly stated, CyberYozh Data operates independently from CyberYozh App. Although both platforms are operated by WebGears Services d.o.o., they provide different products and may be governed by different service-specific policies, licenses, pricing, or documentation.
License to use the Services
Subject to these Terms, CyberYozh grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for lawful purposes.
This license allows you to:
- Access and use the CyberYozh Data website.
- Read and use our documentation and technical resources.
- Download and use software made available through the platform in accordance with its applicable license.
- Access supported APIs and developer tools where available.
- Use the Services for personal, educational, research, or commercial purposes, provided your use complies with these Terms and all applicable laws.
This license does not transfer ownership of any intellectual property rights to you.
Except where expressly permitted by an applicable open-source license, you may not:
- Copy, reproduce, or redistribute proprietary materials.
- Remove copyright, trademark, or attribution notices.
- Use the Services in a way that violates applicable laws or these Terms.
- Attempt to gain unauthorized access to our systems or infrastructure.
We reserve the right to suspend or revoke this license if you violate these Terms or use the Services in a manner that threatens the security, availability, or integrity of CyberYozh Data.
Open-source software
Many components of CyberYozh Data, including Yozh Scraper and Yozh Crawler, are distributed as open-source software under the applicable license included with each project, such as the MIT License where specified.
Your use of any open-source software provided through CyberYozh Data is governed by the license accompanying that software. In the event of any conflict between these Terms and the applicable open-source license, the terms of the open-source license will govern the licensed software.
Nothing in these Terms limits your rights granted under an applicable open-source license.
Open-source software is provided “as is” without warranties except where required by applicable law.
APIs and developer services
CyberYozh Data may provide APIs, developer tools, SDKs, MCP integrations, sample code, configuration examples, and related technical resources to assist developers in building applications and integrations.
When using our APIs or developer services, you agree to:
- Use them only for lawful and authorized purposes.
- Follow any published documentation, technical requirements, rate limits, or usage guidelines.
- Respect website terms, robots.txt directives where applicable, and the rights of third parties.
- Avoid excessive, abusive, or malicious requests that could negatively affect the availability or security of our infrastructure.
- Protect any authentication credentials or API keys issued to you.
We may modify, replace, suspend, restrict, or discontinue APIs or developer services at any time without prior notice as part of ongoing development, maintenance, security improvements, or legal compliance.
Where authentication is required, you are responsible for all activity performed using your credentials.
GitHub repositories and community contributions
CyberYozh Data maintains public repositories on GitHub for selected software projects, documentation, examples, and related developer resources.
We welcome community participation through bug reports, feature requests, pull requests, discussions, and other contributions.
By submitting content to our public repositories, you represent that:
- You have the necessary rights to submit your contribution.
- Your contribution does not knowingly infringe the intellectual property or legal rights of any third party.
- Your contribution complies with applicable laws and these Terms.
Unless otherwise specified, contributions submitted to our repositories may be incorporated into CyberYozh Data projects under the applicable open-source license governing that repository.
We reserve the right, but not the obligation, to review, edit, reject, or remove contributions that violate these Terms, applicable laws, project guidelines, or community standards.
Participation in our GitHub repositories is also subject to GitHub’s own Terms of Service, Community Guidelines, and Privacy Statement.
Acceptable use
CyberYozh Data is intended to support lawful, ethical, and responsible web scraping, website crawling, AI-powered automation, and software development.
You agree to use the Services in compliance with these Terms, all applicable laws and regulations, and the rights of third parties.
You are solely responsible for how you use CyberYozh Data, including any software, APIs, documentation, or open-source components provided through the platform.
You agree not to use the Services to:
- Violate any applicable law or regulation.
- Infringe the intellectual property, privacy, contractual, or other legal rights of others.
- Access, collect, or process information in a manner prohibited by applicable law.
- Distribute malware, ransomware, spyware, viruses, or other malicious software.
- Attempt unauthorized access to systems, networks, accounts, or protected resources.
- Interfere with, disrupt, overload, or damage CyberYozh Data or third-party infrastructure.
- Circumvent authentication, security controls, or access restrictions without authorization.
- Engage in fraudulent, deceptive, abusive, or illegal activities.
- Use the Services to facilitate spam, phishing, credential theft, identity theft, or other malicious activities.
- Misrepresent your identity or affiliation when using the Services.
The examples above are not exhaustive. We reserve the right to determine whether specific activities violate these Terms or applicable law.
Third-party integrations
CyberYozh Data may integrate with or support third-party platforms, APIs, AI assistants, cloud services, developer tools, and other external services.
These integrations may include, but are not limited to:
- Model Context Protocol (MCP) clients
- AI assistants
- GitHub
- Cloud infrastructure providers
- Developer tools
- Third-party APIs
Your use of any third-party service is governed by that provider’s own terms, privacy policy, and applicable agreements.
CyberYozh Data does not own or control third-party services and is not responsible for their availability, functionality, security, privacy practices, or content.
You are responsible for reviewing and complying with any terms applicable to the third-party services you choose to use alongside CyberYozh Data.
Intellectual property
Unless otherwise stated, all trademarks, logos, branding, website design, documentation, text, graphics, original content, and other proprietary materials available through CyberYozh Data are the property of WebGears Services d.o.o. or its licensors and are protected by applicable intellectual property laws.
These Terms do not grant you ownership of any intellectual property rights except as expressly permitted under an applicable open-source license.
You may not use CyberYozh trademarks, logos, branding, or other protected materials in a manner that suggests endorsement, partnership, or affiliation without our prior written permission.
Nothing in these Terms restricts your rights under the applicable license for open-source software published by CyberYozh Data.
User feedback and contributions
We welcome suggestions, feature requests, bug reports, documentation improvements, and other feedback that helps improve CyberYozh Data.
By voluntarily submitting feedback or contributions through our website, GitHub repositories, support channels, email, or other official communication methods, you grant WebGears Services d.o.o. a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, publish, distribute, and incorporate your feedback into our products and services without compensation, unless otherwise agreed in writing.
You represent that you have the necessary rights to submit any feedback or contribution and that doing so does not violate the rights of any third party.
You remain responsible for ensuring that any content you submit is lawful, accurate, and does not contain confidential information that you are not authorized to disclose.
Availability and service changes
CyberYozh Data is continuously developed and improved. We may add, modify, update, suspend, or discontinue any part of the Services, including software, APIs, documentation, integrations, or website features, at any time and without prior notice.
We make reasonable efforts to maintain the availability and reliability of the Services but do not guarantee uninterrupted access or that the Services will always be available, error-free, secure, or compatible with every device, browser, operating system, or third-party service.
From time to time, the Services may become temporarily unavailable due to maintenance, software updates, security improvements, infrastructure upgrades, technical issues, or circumstances beyond our reasonable control.
We reserve the right to introduce new features, modify existing functionality, or retire components of the Services as part of the ongoing development of CyberYozh Data.
Disclaimer of warranties
To the maximum extent permitted by applicable law, CyberYozh Data and all related Services are provided on an “as is” and “as available” basis.
We do not warrant or guarantee that:
- The Services will always be available without interruption.
- The Services will be free from errors, defects, or vulnerabilities.
- Any information or documentation will always be complete, accurate, or up to date.
- The Services will meet your specific requirements or expectations.
- Results obtained through the use of the Services will be accurate, complete, or suitable for any particular purpose.
You acknowledge that the use of web scraping tools, APIs, AI integrations, and developer software involves technical and operational risks. You are solely responsible for evaluating whether the Services are appropriate for your intended use.
Nothing in these Terms excludes warranties that cannot legally be excluded under applicable law.
Limitation of liability
To the fullest extent permitted by applicable law, WebGears Services d.o.o., its affiliates, directors, employees, contractors, licensors, and partners shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your use of, or inability to use, the Services.
This includes, without limitation:
- Loss of profits, revenue, business opportunities, or goodwill.
- Loss, corruption, or disclosure of data.
- Business interruption.
- Downtime or service unavailability.
- Security incidents caused by third-party services.
- Errors or omissions in documentation or software.
- Damages arising from the use of third-party integrations or external services.
Our total liability for any claim arising from or relating to these Terms or the Services shall not exceed the amount you paid directly to WebGears Services d.o.o. for the applicable Service during the twelve (12) months preceding the event giving rise to the claim. If you have not paid for any Services, our maximum liability shall be limited to the minimum amount permitted by applicable law.
Nothing in these Terms limits liability that cannot legally be limited or excluded under applicable law.
Indemnification
You agree to defend, indemnify, and hold harmless WebGears Services d.o.o., its affiliates, employees, directors, contractors, licensors, and partners from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising out of or relating to:
- Your use of the Services.
- Your violation of these Terms.
- Your violation of any applicable law or regulation.
- Your infringement of the rights of any third party.
- Any content, code, data, or materials you submit, publish, or distribute using the Services.
We reserve the right to assume the exclusive defense of any matter subject to indemnification, and you agree to cooperate with us in the defense of such claims.
Suspension and termination
We reserve the right to suspend, restrict, or terminate access to all or part of the Services at our sole discretion where reasonably necessary to:
- Protect the security, integrity, or availability of CyberYozh Data.
- Investigate suspected abuse, fraud, or unlawful activity.
- Comply with applicable laws, court orders, or requests from competent authorities.
- Prevent harm to our users, infrastructure, or third parties.
- Enforce these Terms or other applicable policies.
Where reasonably practicable, we will make reasonable efforts to notify affected users before or promptly after a suspension.
You may discontinue using the Services at any time.
Termination or suspension of access does not affect any rights or obligations that, by their nature, are intended to survive termination, including provisions relating to intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution.
Governing law and jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Serbia, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms or your use of the Services shall first be addressed through good-faith negotiations between you and WebGears Services d.o.o.
If a dispute cannot be resolved through negotiation, it shall be submitted to the competent courts of the Republic of Serbia, unless applicable law requires otherwise.
Nothing in these Terms limits any mandatory consumer rights or protections that may apply under the laws of your country of residence.
Export compliance and sanctions
You agree to comply with all applicable export control, sanctions, and trade laws when accessing or using CyberYozh Data.
You may not use the Services if doing so would violate applicable export restrictions, sanctions regulations, or other legal requirements imposed by the Republic of Serbia, the European Union, the United Nations, or other competent authorities.
You are solely responsible for ensuring that your use of the Services complies with all applicable laws in your jurisdiction.
Changes to these Terms
We may update these Terms from time to time to reflect changes to our Services, legal requirements, security practices, or business operations.
When material changes are made, we will update the Last updated date at the top of this page. Where appropriate, we may also provide additional notice through the website or other official communication channels.
Your continued use of CyberYozh Data after updated Terms become effective constitutes your acceptance of the revised Terms.
If you do not agree with the updated Terms, you must stop using the Services.
Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
Any invalid or unenforceable provision shall be interpreted or modified to the minimum extent necessary to make it enforceable while preserving its original intent wherever possible.
Entire agreement
These Terms, together with our Privacy Policy, Cookie Policy, Acceptable Use Policy (if applicable), and any additional policies or license agreements expressly referenced by these Terms, constitute the entire agreement between you and WebGears Services d.o.o. regarding your use of CyberYozh Data.
They supersede all prior agreements, understandings, communications, or representations relating to the Services, whether oral or written.
